A judge who ruled that prayers in Jesus Name, at the Indiana House of Representatives was unconstitutional, but prayers to Allah were not, has been nominated by the Obama Administration to serve on the U.S. Court of Appeals for the 7th Circuit.
The change we were supposed to believe in is worrying more Americans as the days go by. With the democrats in the majority in both the House and Senate, Dems feel empowered or better yet, a sense of duty to bring forth their version of social change.
Upon ending his Euro-trip, our President decreed to his Muslim audience, “America is not a Christian nation,” a radical break from all his presidential predecessors. Are democrats in touch with the American people or are they exchanging our traditional values for their own ideologies? The recent judicial nominee of the administration proves the latter.
According to Traditional Values Coalition (TVC), Our President has picked “a rabid judicial activist as his first federal court pick. Judge David Hamilton has been chosen to serve on the U.S. Court of Appeals for the 7th Circuit.”
Hamilton, a U.S. district judge in Indianapolis for 14 years, is no stranger to the practice of “activist style judging.” According to TVC, Hamilton is "Someone who ignores the Constitution and imposes his own liberal ideas on each case."
“Judge Hamilton has a long and impressive record of service and a history of handing down fair and judicious decisions," The President said. "He will be a thoughtful and distinguished addition to the 7th Circuit.”
Hamilton is a former ACLU lawyer and was a fundraiser for ACORN, an organization that allegedly engaged in voter registration fraud during the 2008 presidential campaign. Critics believe, ACORN could also be involved in gathering data for the 2010 Census.
Hamilton received the American Bar Association's top rating of “well qualified,” a reversal from 1994 when the ABA said he was “not qualified” to be a judge for the Southern District of Indiana.
Hamilton is also backed by Indiana's Democratic and Republican senators. But TVC argues, "As a judge, Hamilton was a friend of abortionists, criminals, drug pushers and child sex offenders. He made it easier for child sex offenders to move around Indiana by invalidating a law designed to protect children. He helps criminals by suppressing evidence and warrants. He has ruled against waiting periods for those women seeking abortions."
Former Navy Chaplain Gordon James Klingenschmitt, the founder of The Pray in Jesus Name Project, is not sold on the idea of Hamilton ruling in the 7th Circuit of Appeals Court.
In a First Amendment battle over prayer in Jesus' Name, Judge Hamilton as a U.S. District Judge ruled: “The injunction orders the Speaker...that the prayers should not use Christ's name or title or any other denominational appeal...If those offering prayers in the Indiana House of Representatives choose to use the Arabic 'Allah'...the court sees little risk that the choice of language would advance a particular religion or disparage others.”
“Thank God, I took action in 2007 and provided legal arguments to the Indiana Attorney General who appealed to the 7th Circuit Court and we won a 2-1 decision overruling Hamilton, restoring the right to pray "in Jesus name" in Indiana,” Klingenschmitt said.
Klingenschmitt added, "In 2003, Judge Hamilton struck down part of an Indiana law on abortion. The reasonable law had required abortion clinics to simply give women information about alternatives to abortion in the presence of a physician or nurse, 18 hours before the procedure, until Hamilton ruled to hasten abortions. But thank God, the 7th Circuit Court also reversed Hamilton's bad decision in that case."
If confirmed, the Chaplain said, “Hamilton will sit on that 7th Circuit Court, the same court that frequently overruled him, with terrible power to rule the heartland with his anti-life, anti-liberty, anti-Christian agenda.”
Last week, Judge Hamilton was spared of potentially heated questions over his ruling on legislative prayer. Republican Senators on the Judiciary Committee boycotted his scheduled confirmation hearing complaining the process was moving too quickly.
No new confirmation hearing date has been set of yet.
