Man's Law or God's Law -- Which Should Take Priority?

By Fred Jackson and Jody Brown
August 2, 2002

(AgapePress) - The Boy Scouts are under fire again for taking a Bible-based stand against homosexuality. This time, it's a group of California judges.

Pro-homosexual forces have been applying pressure to many organizations over the last few years to punish the Scouts for not allowing leaders who are homosexuals. In some cases, communities have voted to no longer fund the Scouts or allow them to meet on city-controlled property.

Now comes word that San Francisco Superior Court judges adopted a policy in early July that prohibits them from even associating with the Boy Scouts because of the organization's stand against homosexuals.

Jan LaRue
A report from the Culture and Family Institute says the lesbian lawyer who led the campaign against the Scouts is now pushing for a statewide resolution that would apply to all California judges. Attorney Angela Bradstreet said the rationale behind the policy is that it will allow judges to avoid "even the appearance of partiality at all times so that every litigant who appears in front of [them] is treated fairly and equally."

Jan LaRue, chief counsel for the conservative group Concerned Women for America, calls that an "outrageous stance."

"The fact that the California Supremes exempted nonprofit organizations from the nondiscrimination policy for judges, which [the Superior Court judges] have rejected, tells you the real agenda here," LaRue says.

LaRue wonders given the public stand these judges have taken, how can any Scout of person who supports the Scouts ever be sure they will get a fair trial when the appear before these judges.

I Did It My Way
While it is not surprising that superior court justices in San Francisco are giving short shrift to God's condemnation of the sin of homosexuality, it is when representatives for a major Protestant denomination appear to be doing exactly that.

There is nothing ambiguous about the United Methodist Church law that forbids the appointment of "self-avowed, practicing homosexuals" as pastors. But complaints against Seattle ministers who openly declared they are homosexual have been dismissed this year, allowing them to continue to preach.

Associated Press reports that has fueled a debate between Methodists who say church law should be upheld and those who want it changed -- and will ignore it in the meantime. The chairwoman of a Methodist committee that failed to press charges against a pastor who declared herself a lesbian said she could not bring herself to cast a vote against "a pastor of proven effectiveness and moral courage" -- so she ignored church law.
