Thank you for clearing that up for me Paula.
I guess this Newdow character sort of knew what he was doing and did his homework. Thank God for us that it didn't work out for him or any other athiests.
God will make a way where there seems to be no way. (I stole that from Don Moen...sorry)

The reason for the ruling by only 8 instead of 9 Justices was because Newdow had filed a motion requesting that Scalia recuse himself from considering the case on the grounds that Scalia's public comments about keeping the pledge intact might prejudice the case. So Scalia did wind up having to disqualify himself because of this.

Well....it's about time something good comes out of Washington.

My question of curiousity (and an obvious lack of political and judicial knowledge) would be this:

Why did only 8 judges decide this case? Aren't there 9 supreme court justices? The odd number of judges usually breaks a tie situation correct?
